11. Delivery of purchases
All downloadable products such as ebooks and printables provided on joyrandolph.com are delivered electronically via e-mail.
All online courses will be delivered on https://joyrandolph.mykajabi.com/ and you will receive access to the course via email on the date of enrollment.
For purchases of a private one-on-one coaching, the programme will start on the date agreed via email upon purchase.
12. Cancellation’s and Refund Policy
12.1 Digital Downloads
Given the nature of digital downloads such as ebooks, meditations, and products you download and will have lifetime access to, you cannot cancel orders nor get a refund.
12.2 Online courses
We do not offer refunds or credits for change of mind, unused payment plan periods, accidental purchases, medical conditions, or any similar reason or event unless required by law to do so.
However, if you are dissatisfied for any reason, or believe you have experienced extenuating circumstances, we encourage you to contact our Support Team at email@example.com to discuss this further.
If, however, you have purchased the course during a special offer and were offered limited time only 30-day money back guarantee, you can cancel purchases and get a full refund for the online course if you make the request within 30 days of making the initial purchase.
To cancel your purchase, you must notify Joy Glow Ltd within 30 days of purchase. Please email firstname.lastname@example.org.
In this instance, refunds and cancellations are not available beyond 30 days of purchase.
Under all circumstances, if you are on a payment plan, you cannot cancel payments that are over 30 days past the initial purchase. The payments remaining need to be settled by the customer.
12.3 One-on-one coaching
You can cancel a purchase of one-on-one coaching at any time and for any reason whatsoever.
The Client will, however, owe and remain responsible for the pro rata share of the coaching that has been delivered, plus a cancelation fee of £50. This fee reflects the admin costs of setting up and closing the programme.
The Coach reserves the right to cancel one-on-one coaching if at any point she feels it is not advantageous to the Client for the coaching program to continue. If this happens, the Client is only responsible for the pro rata share of coaching services received.
13. Comments and other Posts
Joy Glow Ltd in its sole discretion, may refuse to post, remove, or require you to remove, any content provided by you, in whole or in part, alleged to be unacceptable, undesirable, inappropriate, or in violation of this Agreement.
Joy Glow Ltd may remove any and all content provided by you that is considered derogatory, inflammatory, violent, or graphic in nature. Joy Glow Ltd does not have to provide you with notice before removing any content provided by you. You may not use the Website to solicit or spam anyone and are not permitted to post links that act as solicitation or spam.
We change these terms from time to time and you must check them for changes because they are binding on you.
15. Applicable Law
15.1 The Parties will use their best efforts to negotiate in good faith and settle any dispute that may arise out of or relate to this Agreement or any breach of it.
15.2 If any such dispute cannot be settled amicably through ordinary negotiations between the Parties, or either or both is or are unwilling to engage in this process, either Party may propose to the other in writing that structured negotiations be entered into with the assistance of a fully accredited mediator before resorting to litigation.
15.3 If the Parties are unable to agree upon a mediator, or if the mediator agreed upon is unable or unwilling to act and an alternative mediator cannot be agreed, any party may within 14 days of the date of knowledge of either event apply to LawBite to appoint a mediator under the LawBite Mediation Procedure.
15.4 Within 14 days of the appointment of the mediator (either by mutual agreement of the Parties or by LawBite in accordance with their mediation procedure), the Parties will meet with the mediator to agree the procedure to be adopted for the mediation, unless otherwise agreed between the parties and the mediator.
15.5 All negotiations connected with the relevant dispute(s) will be conducted in confidence and without prejudice to the rights of the Parties in any further proceedings.
15.6 If the Parties agree on a resolution of the dispute at mediation, the agreement shall be reduced to writing and, once signed by the duly authorised representatives of both Parties, shall be final and binding on them.
15.7 If the Parties fail to resolve the dispute(s) within 60 days (or such longer term as may be agreed between the Parties) of the mediator being appointed, or if either Party withdraws from the mediation procedure, then either Party may exercise any right to seek a remedy through arbitration by an arbitrator to be appointed by LawBite under the Rules of the LawBite Arbitration Scheme.
15.8 Any dispute shall not affect the Parties’ ongoing obligations under the Agreement.
15.9 The English courts have the only right to hear claims related to our site, and all
disputes are governed by English law.
